PREFACE
The following draft is only a frame work for a new Democratic Government to replace our current Capitalistic Republic. This new constitution contains all of the Democratic Ideas and Personal Rights of our current constitution but gives all the Governmental Power back to the People.
In order to ratify this new Constitution, the majority of Americans must be in favor of it. This means you (the registered voters) must voice your positive ideas to complete this work. Our very existence may depend on our commitment to finish and ratify this constitution. Our current constitution gives the people the power to change anything in the constitution with a majority vote, let's exercise this right.
In our new government all the registered voters can use a world wide computer link to monitor and control the government. These terminals will be available at every public library or you can use your own home computer.
The network will offer complete access to government records and the hall of records (where every non-fictional book is stored and digitized). The network will also be the main source of communications between the government and the people. The Peoples Computer of Democracy will be the instrument for all official Government transactions. Information on government spending, law proposals, government policies, voting records, candidate's qualifications and other government functions will also be available through the network. The system will use the latest security measures, and anyone convicted of tampering with the system will be exiled from our civilization.
I believe that the educated masses are intelligent
enough to make governmental choices. Why struggle with an outdated form of government which is too expensive, too ingrained and too easily corrupted by special interest groups? The rich devised our current form of Government to serve the rich. It is time for a system devised by the people to serve the people.
Setting long range goals for mankind is one of the themes behind this constitution. Your ideas on mankind's role in the scheme of nature and the universe are welcome. Keep in mind that these goals must reach the heart and souls of all the inhabitants of the planet since the main goal of this constitution is to unite us all.
It is time for the apathetic people of America to voice the need for change and halt this run away Bureaucracy we call a government by ratifying this Constitution as our new Democratic Government.
For now this document will only be available on computer user networks. I invite you to make copies of it and distribute it to your friends to get their ideas and input. Ratification of this constitution is possible only if project sos (Good Old Democracy) involves everyone! Remember, working together we can make a difference, working together we can change the World!

The Constitution of The United Countries


PREAMBLE

WE THE PEOPLE of the United Countries, in order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common Defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United Countries of The World!


Article I Rights of The People


Section 1 - Rights To Liberty

The Right of People to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause with supporting evidence, supported by Oath or Affirmation, and particularly describing the place to be seized and the persons or articles to be seized.
No Person shall be held to answer a capital or other infamous crime unless on a presentment or indictment of a grand jury, except in cases arising in the Militia, when in actual service, in times of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life and limb; nor shall they be compelled in any criminal case to be a witness against him; nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use without just compensation.
Involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist not
within the United Countries, or any place subject to their jurisdiction.

Section 2 - Lifestyle Rights

The State and Federal Governing Systems shall make no law respecting an establishment of religion, or prohibiting the free exercise there of, or abridge the freedom of truthful speech, or of truthful media, or the right of the People to Peaceably Assemble, or the right to petition the Government.
People have the right to Amend or Replace this Constitution on a majority vote. Men of all race, color, and place of origin are considered equal under this Constitution. All Citizens of 5 or more years with a high school degree have the right to vote.
The People shall have a well regulated Department of Defense, being necessary to the security of all States who abide by this constitution, and the right of all licensed Citizens to keep and bear arms, shall hot be infringed. Only active duty solders can possess and use an automatic or assault weapons, all violators will be exiled and the weapon destroyed.
Very old or ill People have the right to die without pain if they will it. In case of unconsciousness, all citizens must specify, and have on file, the condition they must be in to invoke euthanasia. If the individual has no file on record, then the family can approach an ethics council for the approval to invoke euthanasia.
The People who adopt this constitution stand for Freedom, Peace, Love, Intellectual Growth, Justice, Environmental Conservation, Control of Government and Industry, A United Earth, Life, Liberty, and The Pursuit of Happiness.


Section 3 - Women's Rights

Women have the right to sell sexual services but must be medically examined to receive a five day license to do business. The fees for the license will cover the medical examination plus the cost to provide a clean and safe environment in which to work. Women who carry a contagious disease cannot be licensed.
All Women have the right to sterilization or abortion in an affordable certified clinic. Women have the right of free access to a day-after pill to stop a pregnancy or other devices to prevent a one.


Section 4 - Men's Rights

The fees for the license will cover the medical examination plus the cost to provide a clean and safe environment in which to work. Men who carry a contagious disease cannot be licensed.
All Men have the right to sterilization in an affordable certified clinic. Men have the right of free access to a drug or other devices which prevents conception.

Section 5 - Children's Rights

All unborn children have the right to be born into a family that will love and care for them. All parents must have enough capital to invest completely in the child's future. Children have the right to have abusive parents or relatives forced to get help for themselves to correct their behavior, or they can adopt foster parents of their own choosing. All children have the right to stay with the parent of their choice if the parents separate. Industry cannot force children to work and must pay all children at the minimum or comparable wage.


Section 6 - Consumers Rights

The People have the right to change and regulate all forms of entertainment, medicine, industry, government and commerce. People have the right to breath clean air, drink pure water, and eat organically grown and naturally processed foods.
The people have the right to use drugs for recreational purposes. The individuals drug usage will be recorded and kept on file for public viewing and he or she must seek monthly counseling by a certified drug councilor to renew the prescription.


Section 7 - Workers Rights

Workers have the right to serve in a function for which they are qualified and receive fair and equivalent compensation for the services and labor regardless of gender, age, color, creed or past offenses.
The People have the right to work no more than forty hours a week and must be properly compensated for their work in a timely manner with fair wages. For more than 40 hours per week the employer must pay 150% for the first 8 hours and 200% for the next 8 or more hours. These terms can be changed if the majority of the workers agree to the terms of overtime wages. Workers have the right to form a union against companies and strike in a peaceful manner until a fair settlement is resolved. All companies must give employees at least four weeks of paid vacation time every year. Veterans must be offered the job they qualify for before any other applicant.
An employer can retire an employee at an age earlier than 65 if he can no longer perform his function and he or she would be eligible to access retirement funds. But, a two thirds majority vote by his work mates can overrule a management decision.
Section 8 - Governing Rights

The Majority of the citizens have the right to change any law or governing system both in government or business. These changes include but are not limited to: removing and replacing any government or business employee; removing or rewriting any law, stature, or proclamation; adding, removing or restructuring any governmental branch; closing or restructuring any business establishment; and closing or opening any business market.
The right to vote shall not be denied or abridged by the United Countries or by any State on account of race, color, sex religion, or previous condition of servitude.


Section 9 - Fair and Equilateral Trial Rights

In all criminal prosecutions, the accused shall enjoy the right to a speedy public trial of no more than six weeks and has the right to be confronted by the witness against him. The witness has the right to have an armed guard of his choosing for protection at all times before and during the trial. The witness also has the right to change his identity after the trial. The accused has the right to have compulsory process for obtaining a witness in his favor, and to have the assistance of counsel for his defense.
All People committing any crime has the right to be tried by a Jury of twelve impartial people who must unanimously agree on the verdict. If convicted, the criminal must be punished by decree of the law with no exceptions and in a timely manner.
The accused will be considered innocent until proven guilty. Any evidence found pertaining to the case can be used as long as the source is credible. All passed criminal history can be used as evidence and any new evidence that affects the previous verdict requires the case to be retried.
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.


Article II - Responsibility of The People

The People shall not involve Federal or State governments in religious or personal issues. The People shall not commit crimes upon the environment, the Government, or any living being. All People shall use their talents to better society and their own life.
People called to State or Federal Jury Duty must go and the Government will pay them their normal wages until dismissed from the Jury. Employers must allow the worker the time off and to be excused from all duties to serve on the Jury. The People must vote on all issues or must state that the issue is unclear and must not vote on any issue they do not fully understand.
The People shall conserve all natural resources including water, air, plants, animals, and soil.



Article III - Crimes And Their Punishments


Section 1 - The Rehabilitation Centers

Rehabilitation centers will be constructed near old dump sights in all states. All inmates will be stripped of all their rights as a citizen except for their right to life. Inmates cannot be subjected to cruel or unusual treatment.
The function of rehabilitation centers is to provide a controlled environment where inmates are taught maketable work skills before returning to society. The Inmates must choose a job skill they would like to learn but it must take no more than five years to teach to them the skill.
The Rehabilitation center will grow its own food and make its own clothing. The Centers will teach valuable skills by manufacturing goods to compete in the free market. The center will mine old dump sites and recycle all the materials, selling it back to industry. Only the government will be allowed to mine old dumps. The profits made from selling these goods will help offset the rehabilitation centers costs. The inmates will only be allowed to leave the center to work at designated work sites. The Government can use the inmates for any task which is not illegal or violates their right to life.
Inmates will be fed three balanced meals a day. The food will consist of mostly raw vegetables, sprouted beans and grains, and no refined foods. The food will be prepared in the tastiest manner possible using all natural ingredients. The best dishes will be served to inmates as a reward for good behavior. All inmates will go through a two week cleansing fast upon arrival and one four day fast every month there after. Inmates will also be given steam distilled water to drink and herbal, naturopathic or homeopathic medicine to maintain their health. Modern western medicine will be used to treat critical problems only. Any additional items that increase vitality and longevity can be added to the regiment.
Inmates must learn a philosophy of his own choosing that teaches selflessness and respect towards their fellow man. To parallel these teachings inmates will lead meager and plain lives with few material possessions. All inmates will be taught how to love and approve of themselves and build a positive self image. The inmates will be taught meditative methods to contact their higher selves and eliminate stress.
Communication with the outside world will be free and uncensored but can be revoked if abused or as a form of punishment.


Section 2 - Punishment For Violent Crimes

All Parties convicted of planning and willingly committing murder or other violent crimes shall be rehabilitated on the first offense and exiled for any repeated offenses. If the party shows no remorse for his actions the Jury can sentence the accused to death. The choice of death is up to the accused (or the Jury if undecided) and must be carried out in a timely manner. Murder in self defense or by Accident is not a crime.
All parties convicted of allowing a preventable death of an unwilling victim will be rehabilitated for the first offense and made destitute on the repeat offenses. If an individual witnesses a murder and does not report it to the authorities, then he or she will stand trial with the accused as a member of the party.
Murder while under the influence of mind altering drugs requires restitution to the victim's family and a Jury will decide on the required rehabilitation.
All the aforementioned conviction must be proven beyond a shadow of a doubt and cannot come to trial with only superficial or circumstantial evidence.


Section 3 - Punishment For Crimes Against Nature

Polluting or defacing the Environment in any way is against the law. Pollution is the destruction of any plants or animals or the release of poisonous or destructive gasses into the atmosphere or depositing toxic substances in the atmosphere, the hydrosphere or the soil. Gases released by combustion or decomposition will be limited to the amounts that can be readily assimilated by the environment. Pollution is the release of any radiation higher than background radiation. Pollution is noise levels high enough to cause temporary or permanent hearing damage with long exposure times. People or industries convicted of polluting the environment will pay for all the clean up costs necessary to restore the area. The fine for intentional littering will be one tenth the poverty level in that county. The punishment for intentional littering will be three weekends worth of garbage detail cleaning up the county landscape. Landowners must completely clean a sight before it can be sold unless the purchaser agrees to clean the sites. The sight must be proven clean before a change of ownership.
The manufacturing of any chemical that is harmful to any life must be contained on the sites of manufacture. All storage tanks for toxic liquids must be above ground and surrounded by a secondary containment that is continually monitored. All poisonous gas containers must be of tipple vessel construction with continuous leak sensing in the secondary and tertiary containment. All companies that manufacture poisonous gases must be at least thirty miles outside of any large cities and all companies manufacturing toxic solids or liquids must be at least ten miles from any water source or supply.


Section 4 - Punishment For Nonviolent Crimes

Parties convicted of committing any non-violent felonies against another person shall pay the party four times the cost of living in the county the crime was committed in. On the second offense the party will be sent to a rehabilitation center for five years. On the third offense the guilty party will be exiled. People proven to have stolen or embezzled moneys or property shall pay a fine of five times the value stolen and spend five years in a rehabilitation center. Any individual caught possessing illegal goods will be sent to a rehabilitation center and the goods destroyed.
All Parties found guilty of counterfeiting securities or current coinage of The United Countries will pay a fine of ten times the amount counterfeited and spend five years in a rehabilitation center. All Parties shall be Exiled if convicted a second time.


Section 5 - Punishment For Destructive Or Malicious Crimes

Any party convicted of arson must seek counseling on the first offense and shall be sent to a rehabilitation center for five years for each offense there after. Parties convicted of arson must pay for all damages incurred and the cost to put it out.
People can collect damages from a party who commits atrocities on his personal property or family. People convicted of bearing false witness against another in the court law shall be sent to a rehabilitation center for five years and must pay restitution to the one falsely accused.
People shall not operate any vehicle while under the influence of alcohol or any other drug that impedes motor skills, reflex time, or judgment. The first offense will result in the installation of an drug testing security system. This blood level analyzer will not allow an inebriated person to drive the vehicle. The offender will pay all court, and drug addiction therapy costs for a two year drug addiction program. The second offense will result in the total and permanent loss of operating privileges plus paying twice the court costs.
People shall not use force, blackmail, sex, money, religion, or any other form of undue influence to change the mind of another person. People shall not commit fraud against the government or another person and people shall not willfully mislead others. Punishment of the aforementioned crimes is the loss of all moneys and property.


Section 6 - Punishment For Destructive Or Harmful Research

All biological and Genetic research experiments shall be restricted to food crops, the human immune system and recently extinct life forms. Destruction of any ecosystem or species shall be punishable by exile of those responsible.



Article IV - Rights of Foreign Countries

To become part of our Democracy, a foreign countries government pays our Department of Trade and Communications 2% of their quarterly gross export sales pertaining to the United Countries free market. The Department of Trade and Communications will provide computers and connect all of the higher learning schools and public libraries to the Central Computer Network. Individuals can buy a personal computer system from The Department of Trade and Communications or pay for the hook up fee to connect his current system. All the citizens can vote on all issues that could affect their life style or economic well being and all citizen will be protected by the United Country's rights and military defense.

Article V - Peoples Computer Of Democracy


Section 1 - System Distribution

The Government shall give all citizens of five or more years with a high school degree the necessary access software for The Central Computer Network. All public libraries will have enough terminals made available to the registered voters to insure easy access or they can use their own personal computers at home.


Section 2 - System Security

The software disk will contain all of the individuals voting records as well as a secret code generated by the Computer of Democracy. A secret users number will be written upon the disk and returned to the computer of democracy at the time of pick up. The users number will be displayed only the initial start up after which it will have to be entered at start up. The voter will make up her own code when s/he first logs on to the system. The Computer will scan the disk for a precise defect to identify the user and will verify the phone line connection. All of these items must match for a person to vote successfully.


Section 3 - Computer Voting Format

Each issue will be accompanied by a quiz containing four simple multiple choice questions to ensure that the voter understands the issue. The voter must make a score of 3 out of 4 in order to cast a vote. This test will have no time limit and any references can be used. The correct answer and the reason why will be displayed after each choice is made. The questions can be submitted by the people along with the initial proposal. If no questions accompany the proposal then the Council Of Review will compose the questions.
The voter may change his vote at any time before the end of the month when the votes are tallied and the current voting totals will be displayed and updated every five seconds.


Section 4 - The Computer Configuration

The Federal Government will have a central computer complex located deep in the Rocky Mountains. All external hookups to the system will be made with dedicated fiber optics to all the States Central Computer Systems and so on to the local level of government and finally to the citizens via their telephones or libraries. This computer network shall not be connected to any other large computer systems. The system will consist of three or more computers working in tandem to insure zero down time in the event of a computer failure, and the system will have its own power source. The only input and output to the external world will be done through a slave program which is stored in read only memory. A single terminal will be installed in the same room as the computer and it will be from here only that any system changes can be made. This complex and all state connected systems shall be guarded by the local law enforcement at all times.


Section 5 - Computer Communication Functions

The Peoples Computer of Democracy is designed to keep the people informed as to what our elected officials and all the other branches of government have done, are doing, and plan to do. The Computer is also a direct link to the public for the elected representatives. The Public also has access to government records, and can send electronic-mail to any government worker or post messages on any governmental bulletin boards. These mail boxes and bulletin boards are to be used for public government communication on government matters only. Misuse of any part of the system is punishable by exile or death.
Article VI - Government Management System

The management structure for all governmental departments will employ both top down and bottom up management systems. All mangers and supervisors can instigate new methods for providing the same or better services at reduced costs. The individual or group responsible for the cost savings idea will get 10% of the savings realized in the third month. The manger or supervisor whom instigated the changes will get a 2% salary increase if costs decrease and/or service is improved, however if the policy changes result in an increase in costs or worse service then the manger or supervisor responsible for the changes will get a 2% cut in salary for six months.
It is the responsibility of governmental management to insure that all goods and services are provided in a timely manner with a minimum of paper work. All Departments will regularly poll the public to determine if the goods or services have improved or not.
Internal computer systems will be inter-linked through out the government so no internal paperwork is necessary. All records and programs will be stored in devices that can only be written to once in such a way that a computer virus cannot erase the information.
The computer will provide automated sorting of electronic mail and tally all letters pertaining to the same topic and opinion.


Article VII - Goals For Mankind

Mankind will concentrate his time, energy, and money on replacing the environmental damage he has done by reseeding the destroyed rain forest and deserts, repopulating the endangered plants and animals and cleaning up the air and water ways, once again making this planet a garden of eden. The government will educate and persuade the people to live in harmony with their environment.
Government will educate all citizens about their psychic abilities and help them become spiritual enlightened. The Scientific community (with the help of government funding) will concentrate on researching for the tools needed to learn how to use our minds for constructive purposes.


Article VIII - The Definition and Guidelines of Government

Government is a body of persons who provide civil services and are empowered by the people being governed with the necessary authority to perform its function using standard business management practices.
Government is responsible for the protection of all of its citizen's rights and welfare and for the direction and supervision of public affairs as spelled out by this constitution.
Government is obligated to work with business and the people to simplify and economize all interactions. All Government Department Heads and Managers must have work experience in the industries which that department licenses.
The Government and The Church will forever remain separate.
Article IX - The Federal Government


Section 1 - The Responsibility of Federal Review Council

All legislative Powers herein granted shall be vested in the educated citizens of the United Countries, who will empower there chosen representatives of The Federal Review Council.
The Federal Review Council shall be composed of upstanding Citizens, one from every state in every country, having a term of six years and no more than two terms. Council members must be between the ages of 25 and 50 and a citizens of their state for the last ten consecutive years. The Council shall be divided as equally as possible into three groups. Every two years one of the groups will be replaced in a sequential manner by the newly elected council members. Before obtaining their position, all council members must take the following oath "I do solemnly swear before God and these witnesses that I will faithfully serve the Citizens and Constitution of the United Countries and all that it stands for, to the best of my abilities.
The Federal Review Council is responsible for reviewing all legislative issues or proposals supported by a large number of people and to propose a legislative solution if one does not exist, submitting a concise, unbiased and purely factual pros and cons comparison of the issue for voter evaluation.
The Federal Review Council is responsible for reviewing all previous Federal Laws. This Council has the power and responsibility to rewrite all the Laws in clear, concise, and easily understandable English using only simple and compound sentence structure. Each Law will cover only one item and be no longer than three hundred words. Everything implied by the Law as well as its overall concept is binding for all Laws. Every Law must state its purpose and intent in the first sentence and the minimum required punishment in the second sentence. Any Law that is in Conflict with this Constitution must be abolished and taken off the books. Every order, resolution, decree, proclamation or bill to which two thirds of The Federal Review Council does not agree must be voted on by the people. The bill will become a law if the people agree as a majority in favor of the bill. A majority vote by the people can stop any new or rewritten proposal, bill, or ruling from being passed.
All Council members and Government Department Heads and will be a citizen of the United Countries for at least two third of their life and educated in any of the sciences. They will be given a salary increase of ten percent and cost of living adjustments during their term and will be paid out of the Federal Reserve. The Government will install the necessary electronic teleconference equipment at each individual's home or the Government will relocate their family and property and provide a comparable home to live in during their term. The Council member's current job and home will be preserved and returned to them at the end of their term.
A list of the ten most eligible candidates in that state will be posted on the Central Computer Network. The top two will have a run off in the event that no one person holds a majority. There is no need for a party system in a Democracy so we will not use one. The people will have five months to choose their candidate and another month to decide between the top two in the run off. No member shall hold any other office during the time for which he was elected. Eligible candidates shall be selected by the Central Computer Network according to personal statistics and eligibility. Candidates cannot campaign for the position nor accept any gifts of a political nature.
The People shall be the judge of the elections, returns and qualifications of its Council, and a majority of members shall constitute a quorum to do business. A small number of members may adjourn from day to day, and the Council is authorized to compel the attendance of absent members, in such a manner, and under such penalties as are agreed on by the Council. The Federal Review Council may determine the rules of its Proceedings, punish its members for disorderly behavior, and, with the concurrence of two thirds, expel any member.
The Federal Review Council must keep a journal of the proceedings which will be immediately made available to all citizens of The United Country, excepting such parts as may in their judgement require Secrecy; and the Yeas and Nays of all the members shall be recorded. The citizens with top secret clearance can review all issues deemed secret by the Federal Review Council or the previous government.
The Federal Review Council may not adjourn for more than four days without a one third vote of consent by the people. Each Council member is allowed to have four weeks off every year at times of his or her choosing so long as no more than one third of the council is missing at any one time.
The Federal Review Council, by a two thirds majority vote, has the power of impeachment of any heads of departments in all division of the Federal Government or private businesses. Judgement in cases of impeachment shall not extend further than removal from office and disqualification to hold any office of honor, but the party convicted shall nevertheless be liable and subject to indictment, trial, judgement and punishment, according to the law. Impeachment rulings can only be overturned by a majority vote by the people.
The Federal Review Council shall in all cases except treason, felony, and breach of peace, be privileged from arrest during their attendance at the session of the board, and in going to and returning from the same; and for any speech or debate on the board.
The Federal Review Council has the power to hire any individual or group, paying their standard costs, to work on temporary government projects or to act as a temporary consultants or researchers to the council. All Government projects shall be submitted to the people and voted on before initiation. This includes current, military, secret and other research or government projects.
Any profits from these Government projects shall be placed in The Department for Defense and Disaster account or returned equally to each State. These profits can be used to start another project and all Government projects must make new jobs available to the people.
The Federal Review Council will promote energy conservation and progress in Science and beneficial Arts, by securing for limited times to authors and inventors the exclusive rights to their respective writings and discoveries. These and all other original articles and writings shall be printed on acid free high rag content paper and stored in the Hall of Records.
The Hall of Records shall be located under the Rocky Mountains in Colorado and shall consist of an earthquake and fire proof library. All the information contained in the Hall shall be digitized and made available to the Citizens through The Central Computer Network.
The Federal Review Council shall have power to establish a standards and measurements system;
To provide for the common defense and general welfare of the United Territories;
To provide for calling forth the Militia to execute the laws of the Union, suppress insurrection, and repel invasions;
To provide for organizing, arming, and disciplining, the Militia, and for governing such part of them as may be employed in the service of The United Territories, reserving the States respectively, the appointment of the officers, and the authority of training the Militia according to the discipline prescribed by The Federal Review Council;
To make all laws which shall be necessary and proper for carrying into execution the foregoing powers vested by this Constitution in the Government of the United Territories, or in any department or officer thereof.
The people have the power to appoint or impeach a Supreme Commander in times of war by a majority vote but if the people are undecided then The Federal Review Council will appoint a Supreme Commander by a majority vote. The Supreme Commander must give up the office and all powers once a peace declaration is signed and implemented.
All bills for raising revenue shall originate in the Federal Reserve and be approved by The Federal Review Council. All revenues to pay for this department will come from the Federal Reserve. All government departments will publish their expenses on a quarterly basis.
The Federal Government has the right to generate revenues by recycling waste products or manufacturing consumer goods and can loan money to any departments, states, or individuals in need. The money must be paid back as agreed upon by both parties. During times of peace the government can use military resources to generate consumer goods, recycle waste products, repair the infrastructure, and provide disaster aid and rebuilding.
Full Faith and Credit shall be given in each State to the public acts, records, and judicial proceedings of every other State. The Federal Review Council may by general Laws prescribe the Manner in which such acts, records, and proceedings shall be proved, and the effect thereof.
The United Territories shall not grant a title of nobility and no member of government, without consent of the people, shall accept any present, emolument, office, of title, of any kind whatever, from any sovereignty, foreign state, or foreign government.


Section 2 - The Responsibility of The Federal Reserve

The Federal Reserve is responsible for balancing the Federal budget by changing economic factors such as interest rates, licensing fees, State subscription fees, and availability of money. The Federal Reserve has the sole power to coin money in which some of the money is backed with precious metals or minerals, or stones. The Federal Reserve shall consist of a council made up of one elected economist from every state to serve one ten year term.
The Federal Reserve is responsible for setting up an insured retirement savings plan. All working individuals can have any percentage of their wages automatically deducted and placed in a variable interest earning savings account. The interest on the account will be one tenth lower than the current market rate. Upon retiring, at age 65 or later, the funds can be removed by use of a debit card or checks issued to the retiree. These funds can be withdrawn for emergency usage or to purchase a home for the first time. Penalty for early withdrawal will be a ten percent charge. The accumulated interests can be used by The Federal Government for Small Business or Personal loans at rates equal to the current market rate.
The Federal Reserve can loan money to any State in the union but not to a foreign country or entity. The moneys generated by these loans will help fund the Federal Government.
The Federal Reserve will build and maintain a large reserve who sole use is to provide funds for national disasters. This disaster fund can only be used by departments providing disaster relief and must only be invested in ways that are low risk and high liquidity.
All banking, investment, and real estate corporations must be licensed by The Federal Reserve. The cost of the license will be a percentage of the Corporation's gross sales and gross assets. This percentage will be set by the Federal Reserve not to exceed 25%. These fees will be used to fund The Federal Reserve and other Federal Departments. Any excess funds will be added to the disaster relief fund.
Section 3 - The Responsibility of The Department of Public Rights and Welfare

The Department of Public Rights and Welfare shall judge all cases involving more than one thousand times the average cost of living and any cases involving two or more states. All other cases shall be held in the State where the crime was committed. The Department of Public Rights and Welfare is responsible for up holding all of the laws and rights as spelled out in this constitution and is empowered to carry out fully all criminal sentences. The Department of Public Rights and Welfare shall pass no laws without review and agreement by the Council of Review.
All Judges must be between the ages of 35 and 65 and will be sworn in by the president. A two thirds majority vote by the people can remove any Judge and replacements shall be chosen by The Federal Review Council.
The judicial power of the United Territories shall not be construed to extend to any suit in law or equity, commenced or prosecuted against citizens of the United Territories, by citizens of another State, or by citizens of any foreign State.
The Department of Public Rights and Welfare is responsible for controlling illegal immigration and granting citizenship.
All law or legal related Corporations must be licensed by The Department of Public Rights and Welfare. The license fee will be based on a percentage of that Corporation's gross sales and gross assets. This percentage will be determined by The Federal Reserve. The revenues collected by this license fee will be used to fund The Department of Public Rights and Welfare.


Section 4 - The Responsibility of The Department of Defense and Disaster

The Responsibility of The Department of Defense and Disaster is to protect all the borders of The United Territories from enemy invasion. The department is to be made up of three different Militia; the Navy, the Army, and the Air Force.
The Navy shall be responsible for preventing any water invasion and cannot sail into any waters that are not part of The United Territories with out that Territories permission.
The Army shall be responsible for preventing any land invasions into our United Territories. The Army will honor all foreign country's boundaries.
The Air Force is responsible for patrolling all air space directly above our United Territories and for preventing invasion by air or space. The Air Force cannot fly over a foreign Country without that Territories permission.
All branches of the military will use only defensive weapons where possible and all offensive weapons will only operate during an official declaration of war or in designated war game areas. Weapons that simply stun a normal human are the only offensive Weapons allowed to operate in all areas. All missiles and projectiles will be smart and arm themselves only if hostile or evasive action is taken towards it.
The militia may not do any maneuvers in Territories that are not part of The United Territories. The militia cannot declare war or move against The United Territories. Only by a majority vote of The People can The United Territories initiate an offensive action against a non-invading force. The Militia's sole purpose is to insure universal peace and is hereby vested with the power to do so. Only defensive weapons can be sold to Foreign Counties.
During times of peace the Militia will teach their soldiers technical skills by manufacturing consumer goods and maintaining, rebuilding, or updating our Territories infrastructure. Any profits made will help fund the Department of Defense and Disaster.
The Department of Defense and Disaster will license all Defense and Disaster contractors and has the power to make unannounced inspection of these contractors as to their contractual agreements. If the contract is in violation, The Department of Defense and Disaster can revoke the contractor's license to do business until they comply.
The Department of Defense and Disaster will license all infrastructure contractors and will establish all construction codes. The Department of Defense and Disaster has the power to enforce all construction codes using any reasonable incentives and punishments.
The responsibility of The Department of Defense and Disaster is to relocate all people whose homes and property were destroyed by a Natural event. The people will be moved to the place of their choice and a house of minimal cost shall be purchased or constructed and furnished to meet the families basic needs. Funds for this Department will come from the Federal Reserve.
The services and materials used to relocate the families will be provided by the armed forces. A network for collecting relief funds and distributing goods equally among the affected victims are also responsibilities of The Department of Defense and Disaster. The armed forces will provide the personnel and equipment needed to reconstruct any necessary structures damaged by the disaster. These services will be secondary only to invasion of these United Territories.
All Government Contracting Corporations must be licensed by The Department of Defense and Disaster. The license fee will be based on a percentage of that Corporation's gross sales and gross assets. This percentage will be determined by The Federal Reserve. The revenues collected by this license fee will be used to fund this Department. Any extra funds will come from or go to The Federal Reserve.
Section 5 - The Responsibility of Department of Foreign Relations
The Responsibility of The Department of Foreign Relations is to negotiate treaties with foreign Territories to join our union, and to be a watch dog for the people insuring that this constitution is followed to the letter. The funds for this Department will come from the Federal Reserve.
The Department will be headed by The Presidential Team whom, has the power to start a new bill. The Presidential Team may hire any advisers and translators necessary for global communication and understanding.
The Department of Foreign Relations will consist of one heterosexual couple. The couple shall be called the Presidential Team and a majority vote of the people will place them in office. Before taking office both members of the Presidential team shall take the following Oath or Affirmation: - "I do solemnly swear (or affirm) that I will faithfully execute the Office of President of The United Territories, and will to the best of my Ability, preserve, protect and defend the Constitution of The United Territories so help me God."
Candidates will campaign for one year before the election. They will use no more than ten times the average annual cost of living for campaign money, and the Treasury will provide this sole source of campaign funds. Candidates are not to start or belong to any political party since parties are not needed in a Democracy.
Education in negotiating skills and country management is mandatory for all candidate couples and they must be between the ages of thirty and forty years. The candidates shall compete against each other in a physical and intellectual competition and a national debate. All previous accomplishments, failures, and medical records will be made publicly available through the National Computer. These records will be facts substantiated by proof or multiple witnesses. A personality profile will be written on each candidate by a consensus of several co-workers to add to the personal facts files. In case there is no majority a run off between the two or more with the most votes will decide the winner.


Section 6 - The Responsibility of The Department of Trade and Communications.

The responsibility of The Department of Trade and Communications is to Stream-line all interstate trade and to insure the proper use of all communications equipment.
The Department of Trade and Communications will regulate commerce between States and Foreign Nations and is empowered by the people to enforce these import regulations. Importation of goods from another nation who does not subscribe to our democracy is forbidden except for food, minerals and other vital raw materials. The Department of Trade and Communications is responsible for keeping illegal goods from entering or exiting the United States and can use the military to enforce these regulations.
The Department of Trade and Communications is also responsible for collecting subscription fees. Those fees will pay for the installation and maintenance of the Central Computer Network. All citizens who have a high school degree or equivalent have the right to network access. All information will be presented in English only. To simplify exchange and trade all States who become a full member of our union will use The United Territories currency.
The Department of Trade and Communications will collect, from every state, a quarterly subscription fee equal to a percentage of that State's gross state product. The percentage will be determined by the Federal Reserve and will be the same for all states. A small amount of the collected fees will be used to finance The Department of Trade and Communications while most of it will go to the Federal Reserve for distribution. All states belonging to the union will have open access to the United Territories free market. All States will pay a percentage of its annual gross state product as a subscription fee to trade in this free market. The money collected from the states subscription fees can be used by governmental departments that are short of funds.
The Department of Trade and Communications is responsible for assigning the usage of radio frequencies, enforcing their proper usage, and licensing radio operators and manufacturers. The Department of Trade and Communications has the power to seize all illegal equipment and prosecute operators who violate the Law. All electronic equipment must pass radio interference standards test set up by The Department of Trade and Communications.
The Department is responsible for regulating air traffic control and has the power to force airports to update their equipment if it posses a threat to public safety. The Department of Commerce and Communications also has the power to close any airline that does not follow current communications and safety equipment standards.
All Broadcasting and Telecommunication Corporations must be licensed by The Department of Trade and Communications. The license fee will be based on a percentage of that Corporation's gross sales and gross assets. This percentage will be determined by The Federal Reserve. The revenues collected by this license fee will be used to fund This Department. Any extra funds will come from or go to The Federal Reserve.
Section 7 - The Responsibility of The Department of International Transportation

The Responsibility of The Department of International Transportation is to maintain all Interstate transportation systems and shall have the power to regulate the use of these systems. The Department of International Transportation will insure that all means of transportation are efficient, inexpensive, and safe.
The Department has the power to regulate all International transport industries to insure that sufficient funds are collect to maintain safe operating procedures. The Department of Commerce and Communication has complete freedom to examine the operations of all forms of International Transport. The Department of International Transportation has the power to make unannounced inspections on any transportation related business and can revoke their license to do business and impose fines until the business complies to the regulations. The Department of International Transportation can halt any further transport until all violations are cleared up and can impose violation fines.
All transportation related Corporations must be licensed by The Department of International Transportation. The license fee will be based on a percentage of that Corporation's gross sales and gross assets. This percentage will be determined by The Federal Reserve. The revenues collected by this license fee will be used to fund This Department. Any extra funds will go to or come from The Federal Reserve.


Section 8 - The Responsibility of The Department of Better Business

The Department of Better Business will insure that all Corporations run a legitimate business and keep accurate financial records by stream-lining government and business interaction and promoting fair competition in all markets.
A corporation will be defined as any company, partnership, or group residing in more than one state. Any company, partnership, or group with gross earnings of more than one thousand times the average annual cost of living or employing more than 500 people will also be defined as a corporation.
This Department can inspect the operations and financial records of any corporation without prior announcement and can question any of the company executives or accountants. The Department can fine and/or close any corporation who violates the law and does not comply within a reasonable amount of time. The Department of Better Business has the power to prosecute any persons suspected of embezzling funds or using inside information.
The Government cannot set price ceilings or give subsidies to any company or in any way affect the supply or demand sides of the economy. The Department of Better Business has the power to reverse any leverage buy out or stop a hostile take over if it lessens the overall competition in the affected markets. The Department of Better Business will insure business does not price fix or manipulate the market in any way. Companies found to be guilty of this must pay all extra moneys to the affected parties.
The Federal Government can compete actively in any market by starting or buying companies in any State, but the Citizens of the state can at any time veto this action by a majority vote.
Companies owned by the Federal Government must pay all state and local license fees. Government owned companies will give one half of the total profits to the State. The other half of the companies profits will go to the Federal Reserve to help offset the State subscription fees.
All manufacturing, retail sales, marketing, and service related Corporations must be licensed by The Department of Trade and Communications. The license fee will be based on a percentage of that Corporation's gross sales and gross assets. This percentage will be determined by The Federal Reserve. The revenues collected by this license fee will be used to fund This Department. Any extra funds will go to or come from The Federal Reserve.


Section 9 - The Responsibility of The Department Energy and Natural Resources

The responsibility of The Department of Energy and Resources is to keep Factories, Business, Consumers, Scientists and Individual Powers from upsetting or polluting the environment or ecosystem for monetary gains, to insure that all manufactured goods are completely recycled, and that all power sources are not harmful to life. The Department of Energy and Natural Resources has the power to close any business or corporation forcing them to correct all public or environmental damages related to their
operations.
The Department is responsible for protecting wild life by setting up reserves and has the power to force polluters to restore any environment they spoiled. The Department can collect a fee for the use of public camp grounds and national parks to help cover operating expenses. The Department can buy and operate any fire equipment necessary to fight forest fires and can call on the armed forces and volunteer fire fighters to help. The Department can enact legislation to control the destruction of natural resources or wild life.
The Department will regulate the amount of gasses released into the air and the way in which energy is produced. Scientists will determine how much carbon dioxide the Earth can absorb in a year and this total shall be divided among the Territories according to each Territories adult populations. These carbon rights restrict the amount of carbon dioxide a company can generate. Any carbon generating device that a company manufactures must be covered by his purchased carbon rights. The department can use any means to force a company or individual to comply with the carbon rights law. Territories can trade their unused carbon rights with other Territories in exchange for technology that lowers their carbon pollution.
All companies who manufacture energy by passive means will pay only one half the licensing fees. State funding will be available for any passive energy improvements, projects, or research.
All energy, farming, mining, and waste material related Corporations must be licensed by The Department of Energy and Natural Resources. The license fee will be based on a percentage of that Corporation's gross sales and gross assets. This percentage will be determined by The Federal Reserve. The revenues collected by this license fee will be used to fund This Department. Any extra funds will go to or come from The Federal Reserve.


Section 10 - The Responsibility of The Department of Drugs and Agriculture

The responsibility of The Department of Drugs and Agriculture is to insure that food is made without the use of chemicals or petroleum products using only animal and/or vegetable products. The responsibility of The Department of Drugs and Agriculture is to insure that all drugs are proven safe to humans and regulated.
The Department of Drugs and Agriculture is empowered to make low interest federal loans to farming families only. The Department of Drugs and Agriculture has the right to make unannounced spot inspections on any or all manufacturing processes and can close the plant until the company complies with the regulations. Manufactures must pay complete compensation to any customers who were harmed by their products.
The Department of Drugs and Agriculture shall insure that livestock is not raised in a confined or harsh environment that promotes disease or environmental destruction. The Department will not allow ranchers to use synthetic drugs or hormones to increase the growth rate of the livestock.
Chemical fertilizers that cause water pollution and soil sterilization cannot be used. Pesticides that remain toxic for more than three days after being exposed to the air can no longer be used.
All farm land having a grade of more than 8% shall be planted back to prairie grass so as to prevent soil erosion.
Food products cannot be exposed to any poisons or other inedible substances. All foods must be sold raw and cannot be denatured in any way unless it is proven to be totally safe. Homogenization and hydrogenation are both harmful processes.
Manufactures or retailers cannot store food and chemicals in the same building. All food containers must be chemically inert or made from natural materials. Natural means any substance taken from the ocean or the surface of the planet. All food products must plainly show the date of manufacture or the date harvested and the shelf life. Labels must show a complete and specific list of ingredients and nutrient content.
All synthetic drugs and their manufacturing process must be proven totally safe to people and the ecosystem by competent parties with no vested interest before the product can be manufactured or distributed. The Department of Drugs and Agriculture will certify these testing companies. The company proposing the new drug must pay all the testing expenses. All drugs must pass all tests required by the Department of Drugs and Agriculture.
All food and medical related Corporations must be licensed by The Department of Drugs and Agriculture. The license fee will be based on a percentage of that Corporation's gross sales and gross assets. This percentage will be determined by The Federal Reserve. The revenues collected by this license fee will be used to fund This Department. Any extra funds will go to or come from The Federal Reserve.


Section 11 - The Responsibility of The Department of National Security and Investigations

The responsibility of The Department of National Security and Investigations is to keep all Articles, Ideas, and Projects, deemed Top Secret by The Review Council, from public disclosure except those whom have Top Secret clearance. All previous secret technology that is harmless will be publicly available.
The Department of National Security and Investigations must set up secure rooms in every county from which people with clearance can vote on Top Secret issues. The Top Secrete computer voting system will use voice print, finger print, and retinal scan for user identification along with the password system used on the public computer voting system. The room shall be guarded at all times and users will sign in and out. A majority consent by the cleared people is required to start any Top Secret project. The Review Council will review all current Top Secret projects and programs on a quarterly basis. A majority vote by The Review Council can terminate any programs that are extremely hazardous to the environment or political stability of any state or foreign country.
The Department of National Security and Investigations is responsible for capturing criminals whom have fled this country or those who committed crimes in multiple states. The Department must give aid to local law enforcement agencies who request their help. The Department will search for people who are reported missing or kidnapped outside their home state or those who have been reported missing over one year.
All entertainment and Insurance related Corporations must be licensed by The Department of National Security and Investigations. The license fee will be based on a percentage of that Corporation's gross sales and gross assets. This percentage will be determined by The Federal Reserve. The revenues collected by this license fee will be used to fund This Department. Any extra funds will go to or come from The Federal Reserve.


Section 12 - The Responsibility of The Department of Exploration and Research

The responsibility of The Department of Exploration and Research is to provide the necessary communication satellites for the Central Computer Network and all other forms of public communication as well as a service to industry for launching private satellites and other space research programs. The Departments long term goals are to create new jobs in space and
on other planets by perfecting space travel and teraforming (to create a life sustaining planet from a lifeless one).
All critical phases must have unanimous approval by all engineers and scientists involved before proceeding. Any team member can launch an internal investigation from an outside agency to overt any dangerous proceedings or tests.
All contractors to The Department of Exploration and Research cannot charge more than fifty percent above the cost of production. Only companies capable of producing the item can bid on a contract and the most capable company with the second lowest bid will be awarded the contract. Any significant changes made later to the contract will require the bidding to be reopened.
All Aero-space, High-tech, and Education related Corporations must be licensed by The Department of Exploration and Research. The license fee will be based on a percentage of that Corporation's gross sales and gross assets. This percentage will be determined by The Federal Reserve. The revenues collected by this license fee will be used to fund This Department. Any extra funds will go to or come from The Federal Reserve.


Article X - State Government


Section 1 - The Responsibility of The State Review Council

All legislative Powers herein granted shall be vested in the educated citizens of the United Territories, who will empower there chosen representatives of The State Review Council.
The Responsibility of The State Review Council is to review all current State laws and rewrite these documents using only simple, concise, and clearly understandable common English. The State Review Council will remove any unjustifiable laws or laws that are in conflict with federal laws or this constitution. All new or proposed laws shall be written using simple English construction. All laws must be passed by a majority of the people if less than three quarters of the Council is in favor of it. All Council members will write a summary of 100 words or less on why they are for or against a law being put to a public vote.
All laws will state the intent and directive in the first sentence followed by the punishment if violated. All laws will cover only one topic or problem and be no more 200 words in length. The State must immediately enforce all newly passed laws. The council may not add to or subtract from any new proposed law but the people who vote against it may put on record which portions they were against. The Council must remove any of these portions which have a majority veto and the proposal will be resubmitted with those sections removed. This process will continue for three rounds before the proposal is dropped.
The State Review Council has the power to enact and enforce any new legislation necessary to comply with the demands of this constitution or the demands of the majority.
The State Council must support their Federal Review Council member who will submit accurate quarterly activity reports available to the people in his state. These Reports will also include any judgement the State Council may have on his activities.
The State Review Council has the power to create or eliminate departments and to appoint or remove any heads of state as necessity demands. The people have the power to stop any action by the State Scientific Council with a majority veto.
The Departments for which The State Review Council are responsible for are: The Department of State Justice, The Department of Public Health And Safety, The Department of Medical Welfare, The Department of Education, The Department of Better Business, and The Department of Transportation.
The state's population will elect Council members for a five year term by a majority vote. Every one of the following sciences will be represented by a different council member:
Aeronautics, Archeology, Astronomy, Biology, Chemistry, Computer Science, Electronics, Geology, Mathematics and Nuclear Physics.
One Council member will be replaced every six months in a rotating manner. The Votes for the new replacement will be totaled at the end of the six months. If no candidate has a majority then a run off between the top two will be totaled at the end of the following month.
Campaigning for the position is not permitted since this is not a popularity contest. A list of the ten most qualified people will be published including the candidate's professional history, accomplishments and personality. These personality files will be written by a group of peers who work in his field of science and will contain only factual history both good and bad. An individual can decline from the elected position if he has already served on the council or if discontinuing his current work threatens national security or the States economy.
Funds necessary to run this department will be provided by The State Reserve.


Section 2 - The Responsibility of The State Reserve

The State Reserve is responsible for balancing the state budget and has the power to raise or lower licensing fees to accomplish this. The State Reserve will determine if an industry renews it's license on a quarterly, semi-annually or annually basis. The State Reserve can distribute money to departments low on funds and, departments with excess funds must release them for redistribution. The State Reserve will publish a quarterly expense sheet showing all state government expenditures and projected expenditures of the next six months.
The State Reserve must at all times maintain enough capital in reserve to pay for a large natural disaster. These moneys cannot be spent on any other expenses but can be invested in high liquidity conservative funds. All capital gains and or interest income generated by this fund must be placed back into the fund.
The responsibility of The State Reserve is to study the economics within each county and to determine the cost of living for a single person and a family of three for every county within the state. The cost of living will be the minimum total cost in food, housing, clothing, health services, and other necessities required for minimal living. This will be an average based on monthly studies and reported to the public and the Federal Reserve twice a year.
The State Reserve can launch internal investigations to find ways of reducing costs within the state government and can prosecute any individual found wasting or misusing funds.
A Government employed workers list showing the total number of workers by order of job classification and salary must be published once each year for every State Department.
All Small Investing, Banking, and Loaning Businesses must be licensed by The State Reserve. The license fee will be based on a percentage of that Business's gross sales and gross assets. This percentage will be determined by The State Reserve not to exceed 10%. The revenues collected by this license fee will be used to fund This Department. Any extra funds will be added to the state disaster fund.


Section 3 - The Responsibility of The State Justice

The Responsibility of The State Justice shall be to hold court proceedings on all crimes against the people or the state. Any cases that could not be settled in local courts will go to The State Justice Court. The State has the power to rehabilitate or exile any person found guilty of the crime. The People or The State Review Council have the right to pardon any convicted criminal by a majority vote.
The accused has the right to choose his own councilor for his defence. The job of the councilor is to inform his client as to his options according to the law. The councilors job is to work with the police and other authorities to prove what actually happened in this case. Councilors cannot used any persuasive tactics to slant the evidence or influence the Jury. Any facts found by the councilor must be shared with the opposing councilor and police. The police and both parties must share all the relevant facts in the case. The Jury will then decide if the accused is guilty or innocent.
In all public courts the winning party must pay all court fees and each party will choose council from a list of available councilors. All the councilors on this list will have comparable skills based on past performance. Councilors will be paid according to the number of clients he has counseled and based on his performance.
The State Justice Department is responsible for employing only the best councilors and insuring that the law schools are properly training them. All public councilors must work for the federal, state, or local governments. The State Justice department can refuse to license any private councilors for working in a public court and compromising the right to equal representation.
A judge will preside over the court to insure that the proceedings are proper and just. All state trials shall be recorded in video, audio and written medias in unedited form and made publicly available after the Jury or judge reaches a verdict. All proceedings shall be recorded and placed in the state hall of records the next day. The State Hall of Records will be available to the public at all times.
The news media cannot make any announcements about future or current trial proceedings. Every county will have at least one State Court and an additional one for every 50,000 people. All State Justices shall be elected every 10 years and cannot hold office over the age of 70. The election process will be done on a rotation basis and the people can remove any Justice or councilor with a majority vote.
The selection process will be the same as the State Council election system. The people will choose their replacement from a list of the 10 most qualified people or any qualified Judge who is not on the list. The list will be made up by the State Council of Review.
All Private Lawyers and Insurance Related The State Justice. The license fee will be based on a percentage of that Business's gross sales and gross assets. This percentage will be determined by The State Reserve not to exceed 25%. The revenues collected by this license fee will be used to fund this department. Any extra funds will go to or come from The Federal Reserve.


Section 4 - The Responsibility of The Department of Public Health and Safety

The responsibility of The Department of Public Health and Safety is to prevent the spread of infectious diseases and insure that the public is supplied with chemical free food water and healthy living environments.
A number of independent laboratories will be contracted by the state to certify the quality of all water supplies. These independents must publish the test results on the state computer network and any falsified records will result in the closing of that laboratory and conviction by trial of those responsible. The Department must insure that cities remove all contaminates from the water sources before supplying it to the public.
All businesses must first buy all of the recycled material from government recycling centers at the current market price before buying any materials elsewhere. The department will insure that these recycled materials meet industry standards and are of a high grade.
The Department of Public Health and Safety must recycling or proper disposal of waste materials, include those from medical facilities. All manufacturers will recycle the materials or products they manufacture or pay the expenses to have it properly done by another party. The manufacturer will be responsible for any violations made by the company recycling the product. The recycling process will be made as convenient as possible for the consumer. The Department of Public Health and Safety will insure that toxic substances, used by the public or industry, are easily returnable to the manufacturer after its use. The dumping of any toxic substances is a capital offence punishable by exile.
All food or recreational drug related businesses must obtain a license from The Department of Public Health and Safety to do business. The fee for this license will be equal to one percent of the food business' gross sales and gross assets and ten percent for the recreational drug related business gross sales and gross assets.
The Department of Public Health and Safety must take in all abandoned, lost, homeless, or runaway children until their parents are found or they are legally adopted. Parents found guilty of abusing or neglecting their child will loose all rights and entitlement to that child. The parent must willingly seek help for himself or herself and the family will be reunited after he or she is cured. During treatment, the child will stay with a family member or can stay with a foster family if s/he chooses. The Department must enforce all rights stated in the Children Rights section.
The Department has the power to force any manufacturer to child proof their products and must insure that all hazardous consumer goods have child-proof safe guards that are effective. An company must pay restitution to the family of a child that was harmed by a product stored according to the manufactures instructions. The Department has the power to force the company to pay restitution and can close operations if there is no compliance or resolution.
The employees of any company can work with the Department to set up a company operated on-site day care center for its employees.
The Department of Public Health and Safety and Welfare is responsible for insuring that all nursing care homes and retirement homes are properly run. The Department can severely fine or close any elderly care businesses that do not comply with the laws.
The Department has the power to make all the necessary legislation to protect the public from poor care. The people can change any regulations with a majority vote.
All Food and Waste Related Businesses must be licensed by The Department of Public Health and Safety. The license fee will be based on a percentage of that Business's gross sales and gross assets. This percentage will be determined by The State Reserve not to exceed 25%. The revenues collected by this license fee will be used to fund this department. Any extra funds will go to or come from The Federal Reserve.


Section 5 - The Responsibility of The Department of Public Welfare

The Responsibilities of Department of Public Health and Safety is to help people who are unemployed find work and to provide education for those who lack skills to do the available work.
Welfare payments will supplement all working individuals who do not earn more than the cost of living in that county. The state will provide training programs so welfare recipients can obtain a higher paying job. People on welfare with no job or living on the streets cannot refuse to work for the Government.
The Department of Public Welfare is responsible for the welfare of the Handicapped and Mentally Disabled people. Mentally disabled or handicapped people who cannot look after themselves shall be cared for in nonprofit privately run housing that is publicly owned and subsidized by the government. These institutions are responsible for helping these individuals to become productive members of society; not to lock them behind closed doors and drug the patients needlessly. Employers may employ handicapped people at less than the minimum wage and the government will subsidize the rest of the individuals income to meet the county's cost of living.
All Prostitution, Recreational Drug, Human Care Businesses must be licensed by The Department of Public Welfare. The license fee will be based on a percentage of that Business's gross sales and gross assets. This percentage will be determined by The State Reserve not to exceed 25%. The revenues collected by this license fee will be used to fund this department. Any extra funds will go to or come from The Federal Reserve.


Section 6 - The Responsibility of The Department of Medicine

The Department of Medicine is responsible for licensing all practitioners of medicine. All doctors shall have a holistic approach to medicine treating the physical, spiritual, and mental aspects of the patients. All Practitioners will know what the effects of diet and environment can have on an individual. Doctors can specialize in any of the following forms of medicine: Naturopathy, Homeopathy, Live Cell Therapy, Herbs, Chiropractic, Acupuncture, Biofeedback, Hypnosis, Psychotherapy, Physical Therapy, Surgery, Drug Treatment and Radiation Treatment. Doctors will know which of these treatments work best for a particular disorder and send his patient to the correct specialist if he is not.
All doctors shall have knowledge of all forms of medicine both physical and spiritual. Only as a last resort in life and death situations can practitioners use major surgery, strong drugs, or radiation to save a patient. Doctors will not take heroic measures to save a badly maimed or terminally ill patient unless the patient signs a contract with the state to do so. This contractual agreement will be part of the individuals medical record and stored on his electronic medical card. Drugs, radiation and major Surgery will be used only as a last resort after all other methods failed to cure the problem or in the event of a critical emergency.
Payment to Doctors or health organizations will be on a monthly basis and payment will continue only when the patient is in good health. Payment will be determined only by a patient's passed health record. Health services cannot not be discontinued while a patient is ill or in poor health. A patient can only be diagnosed well by himself or by another doctor of his own choosing. This fitness examination will be paid for by the health organization or the doctor giving the treatment. The past records of all practitioners will be publicly available and must list the failed treatments as well as the cured patients. This information will be added to a data base for use by all practitioners as a diagnostic tool.
The Department must enforce these guide lines and must prosecute all Practitioners who do not follow them. Repeat offenders must have their license taken away and their practice permanently closed.
All drug manufactures, medical institutions, and medical practitioners must be licensed by The Department of Medicine. The license fee will be based on a percentage of that Business's gross sales and gross assets. This percentage will be determined by The State Reserve not to exceed 25%. The revenues collected by this license fee will be used to fund this department. Any extra funds will go to or come from The Federal Reserve.


Section 7 - The Responsibility of The Department of Education

The Department of Education must insure that our children are taught by qualified professionals the skills necessary to be a productive member of society. The Department has the power to remove any teacher, however the students or parents of that school can override the decision with a majority vote.
A nation wide scholastics test given four times during the term will determine whether the student continues to the next grade. The last exam will be comprehensive and count for 50% of the total and take no longer than 4 hours to complete. The Department of Education will hire teaching professionals of high standing to design the questions on the national exams. These questions will cover completely the subject matter at the required difficulty for that grade. The schools with the highest score will be the model for rest of the Nation and all lower scoring schools will be required to incorporate the better teaching methods into their programs.
The teacher's responsibility is to insure that all the students pass the National exams. Teachers do not need to have a credential to teach only the knowledge and the ability to convey the subject matter to others. All Teachers will have to take a yearly exam to show they have the knowledge and ability to teach their chosen subjects. The department must make available to the schools the necessary materials for the teachers to perform their task.
Students twelve years or older who are discipline problems will be sent to a militaristic school. This school will teach the same material in a much more controlled and isolated environment with emphasis on discipline and responsibility. After graduating from high school they will enter the armed service of their choice and spend at least five years there.
All Entertainment, Recreational, and Advertising businesses must be licensed by The Department of Education. The license fee will be based on a percentage of that Business's gross sales and gross assets. This percentage will be determined by The State Reserve not to exceed 25%. The revenues collected by this license fee will be used to fund this department. Any extra funds will go to or come from The Federal Reserve.


Section 8 - The Responsibility of The Department of Small Business

The Department of Small Business shall be responsible for all businesses in the state that employ fewer than 500 workers and to insure these companies are not endangering their employees, nearby residents, or environment. The Department is responsible for making available to small businesses the means and information for proper waste disposal or recycling procedures (which will be as simple and inexpensive as possible).
The Department can make spot inspections at any time and can close down any part or all of the operation until the business passes inspection. The Department has the power to fine the company for any infraction and the amount of that fine will be determined by the relative danger of the infraction.
All small businesses qualifying for group medical rates must offer minimal medical coverage to their employees. If an employee does not want group medical or the employer does not qualify then the employer will pay one half of the employees medical coverage.
Companies must pay for all medical expenses for any injury that they were directly or indirectly responsible for.
All Small Businesses will report to the state all business operations at least once a year and the business shall keep accounting records for the last five years. All business deals and contracts will be a matter of public record available to all registered voters.
The Department of Small Business will be a watch dog for fraudulent companies insuring that the company's products or services live up to their claims. False claims will result in the return of all moneys collected and a fine levied against the company. The false claim must be correct to accurately reflect the product or service.
The Department can require testing of any potentially hazardous products manufactured in the state for safety, reliability, and advertizing claims at the companies expense. The Department has the power to fine or fire any employees responsible for multiple repeated infractions. If a company manufactures a product or sells a service that does not meet its claims, The Department of Small Business can fine or close the company and sell all of its assets.
All manufacturing, retail sales, marketing, and service related businesses must be licensed by The Department of Small Business. The license fee will be based on a percentage of that Business's gross sales and gross assets. This percentage will be determined by The State Reserve not to exceed 25%. The revenues collected by this license fee will be used to fund this department. Any extra funds will go to or come from The Federal Reserve.


Section 9 - The Responsibility of The Department of Personal Transportation

The Responsibility of The Department of Transportation is to issue personal driving and flying licenses and to insure that inexpensive and environmentally safe commuter transportation is available to the public. Flying licenses and testing shall be subject to the laws and regulations of the Department of International Personal Transportation. Driving licenses shall be given to only competent drivers who understand all the laws of safe driving. No person sentenced to exile shall be issued a license.
The Department of Personal Transportation will regulate the amount of weight carried by trucks and maintain all state highways. Taxes on tires and fuel will generate revenue for road repairs.
Commuter vehicles shall be powered by a zero emissions power source using regenerative braking, electrodynamic shock absorbers, and a built in electromagnetic regeneration system. The auto manufacturers will build the vehicles with standardized recyclable parts. To insure that all personal transportation is safe in a high speed collision, all vehicles must included some form of automatic restraint system.
The Department of Personal Transportation will require all vehicle operators to own drivers insurance. The operator of the vehicle is responsible for the costs of any and all damages, injuries or deaths incurred as a result of his operations. In the event of an accident the drivers of all the vehicles involved will split the total cost equally. Driving under the influence of an inebriating drug is forbidden and must pay all costs incurred by any accident s/he is involved in.
The State can sell policies at the lowest rates possible and the income will go towards the Departments operating expenses. The Department will run a zealous organization and give any profits back as a tax rebate. Private companies can sell drivers insurance to the public, and the accounting records of all private and government insurance companies will be open to the public and available on the Central Computer Network.
All businesses related to transportation must be licensed by The Department of Personal Transportation to do business. The fee will be equal to 5% of the companies gross sales and gross assets.
All transportation related businesses must be licensed by The Department of Personal Transportation. The license fee will be based on a percentage of that Business's gross sales and gross assets. This percentage will be determined by The State Reserve not to exceed 25%. The revenues collected by this license fee will be used to fund this department. Any extra funds will go to or come from The Federal Reserve.


Section 10 - The Responsibility of The Department of Public Lands

The Department of Public Lands is responsible for maintaining all state parks and recreational facilities and the protection of state wildlife reserves.
The Department can buy and operate any fire fighting equipment necessary to fight forest fires calling on volunteer fire fighters and the armed forces for help. The Department can enact legislation to save, protect or replenish the natural resources or wild life.
The Department can collect a fee for the use of public camp grounds and national parks to help cover operating expenses. All small real estate, mining and farming related businesses must be licensed by The Department of Public Lands. The license fee will be based on a percentage of that Business's gross sales and gross assets. This percentage will be determined by The State Reserve not to exceed 25%. The revenues collected by this license fee will be used to fund this department. Any extra funds will go to or come from The Federal Reserve.

Purposed Laws and Programs


Section 1 - Business

The Department of Commerce and Communication must insure fair competition among competing companies and insure that no price fixing occurs between them. Companies that offer power or fuel as a product must immediately raise and lower their prices in direct relation to the change in raw material or internal costs.
The Department of Trade and Communication will insure that television stations show commercials on half hour intervals totalling no more than 20 minutes each hour, and that adult material is shown between the hours of 11:00 pm and 5:00 am local time.


Section 2 - Prostitution

The Department of Public Health and Safety is responsible for controlling the spread of venereal diseases by examining all men and women selling sexual favors. The Department will house and educate these men and women so that they can lead a more productive and safe life.
Women or men selling sexual favors must obtain a license from The Department of Public Health and Safety by passing an infectious disease examination before being licensed. The fees for the license will cover the medical examination plus the cost to provide a clean and safe environment in which to learn and work. Women or men who carry a contagious disease cannot be licensed and a license is only good for five days. The Department of Public health can fine and examine any person selling sexual favors without a license. Any person found guilty of selling sexual favors and knowingly spreading an infectious disease shall be sent to a rehabilitation center for five years.
Any person found guilty of mentally, physically or sexually abusing a sexual favor seller will be persecuted the same as any other violent crime offender.


Section 3 - Homeless and Jobless

The Local Government will set up and run garbage recycling centers that house and educate the unemployed or homeless giving them a job to do for society while teaching them a valuable job skill. Private industry will set up and operate the training and day care centers within the facilities. The department of Public Health and Safety and Welfare will pay for all the training and day care expenses. The Council of Review is responsible for setting up all waste recycling plants and has the power to send welfare abusers to these plants. The workers are free to leave any time they wish but cannot be a burden on society by begging.
Unemployed people can only collect unemployment if they were laid off. The amount of unemployment will be equal to the cost of living and will continue for six months or less if a new job is found before the six months are up.

GLOSSARY


Exile - To remove someone from civilized society by abandoning
him in a hostile environment (such as a jungle, desert, or open sea) with one survival kit containing: three day supply of food and water, a survival book, one survival kit, and one book of his/her choice. Or the convicted can sign a waiver giving all rights of his body and life to scientific research and experimentation. If he survives exile, he will go through rehabilitation after which, he can return to society. The type of exile and the location will be decided on by the jury and may have a possible estimated chance of survival of no more than ten percent.

Cost of living - The cost of living is the minimum amount of
money needed for a single person, a married couple or a family of three to survive in a given county for one year. This includes the cost of: housing, food, clothing, and medical expenses.

Gross Assets - The amount of revenue received if the business
were sold at the fair market value.

Gross Sales - The total amount of revenue received from the
customers in exchange for goods and/or services rendered.
